These Terms of Service ("Terms") govern your access to and use of the Uhtend website at https://uhtend.com and the Uhtend subscription pass service (collectively, the "Service"), operated by Anthony Stephen Mendes as a sole proprietorship based in Mumbai, India ("Uhtend," "we," "us," or "our").

By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About Uhtend

Uhtend is a subscription pass that gives subscribers access to view and attend events and experiences. To use the Service, you must create an account. Access to specific events may require clicking an event link and/or holding an active subscription.

2. Eligibility and Accounts

• You must provide accurate information, including your name, age/date of birth, and location, when creating an account.

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

• You agree to notify us immediately of any unauthorized use of your account.

3. Subscriptions and Payments

• Subscriptions are managed and billed through Dodo Payments.

• By subscribing, you authorize recurring charges in accordance with your selected plan, until you cancel.

• You may cancel your subscription at any time using the cancellation link in the email you receive from Dodo Payments upon subscribing.

• All payments are final and non-refundable, as described in our [Refund Policy].

4. Location-Based Check-In

Uhtend uses location-based check-in to verify attendance at events. When you are within approximately 100 metres of an event's location, and location services are enabled on your device, you may be automatically checked in to that event.

You are responsible for enabling location permissions if you wish to use this feature. Uhtend is not responsible for check-in failures due to disabled location services, device issues, or connectivity problems.

5. Code of Conduct

Uhtend expects all subscribers and users to behave in a cordial and respectful manner at all times, both on the platform and at events. You agree not to:

• Use the Service for any unlawful purpose

• Violate any applicable law or regulation

• Break any platform rules communicated by Uhtend

• Engage in behaviour that is disruptive, abusive, threatening, or harmful to other users, event organizers, or staff

6. Account and Event Bans

Uhtend reserves the right, at its sole discretion, to:

• Suspend or ban a user's account for unlawful usage, violation of platform rules, or other misconduct

• Ban a user or subscriber from attending Uhtend's events based on their behaviour, whether on the platform or at an event

Such action may be taken without prior notice and without any obligation to issue a refund, in accordance with our Refund Policy.

7. User-Generated Content

Any content you upload, post, or submit to Uhtend (including photos, reviews, or other materials) may be used by Uhtend for promotional purposes and to improve our products and services. By submitting content, you grant Uhtend a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display such content for these purposes. You represent that you have the right to submit any content you upload.

8. Use of Data

Uhtend may use data collected from your use of the Service, including account and usage data, to operate, maintain, and improve our services. Please see our Privacy Policy for further detail on how we collect and use your information.

9. Advertising

Uhtend may display advertisements to signed-in users while browsing events and experiences listings, as described in our Privacy Policy.

10. Intellectual Property

All content, branding, and materials on the Site and Service, other than content submitted by users, are the property of Uhtend or its licensors and may not be used without prior written permission.

11. Disclaimers

• The Service is provided "as is" and "as available," without warranties of any kind, express or implied.

• Uhtend acts as a platform connecting subscribers with events and experiences. We are not responsible for the conduct of event organizers, venues, other attendees, or third parties, nor for the quality, safety, or legality of any event listed on the platform.

• Attendance at any event is at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, Uhtend shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, your attendance at any event, or your inability to access the Service.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violations of these Terms. You may stop using the Service and cancel your subscription at any time as described in Section 3.

14. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
